TERMS & CONDITIONS
 

By entering the ‘East Gippsland Sportfishing Giveaway’ (‘the Competition’), you agree to the following terms and conditions of entry (the ‘Terms and Conditions’):

1. Standard Terms

2. Who can enter?

1. Subject to clauses 2-2 and 2-3, entry is open to all residents of Australia.

2. Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of East Gippsland Sportfishing (EGS) are not eligible to enter.

3. Entrants must be over the age of 18.

3. How to enter

1. The Competition commences on Thursday 01 February 2024 at 9:00am (AEST) and concludes on Friday 1st March 2024 at 12:00pm (AEST) ("the Competition Period").

2. Entries must be received during the Competition Period. EGS takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.

3. To go into the Competition, entrants must subscribe to the EGS database, thereby affording the party permission to send updates and information post promotion.

4. Only one (1) entry is permitted per person.

5. There is no cost to enter the Competition; however, internet connection and usage rates may apply. Entrants should obtain details of such costs from their service providers. EGS is not and will not be liable for any such costs.

6. EGS may reject an entry if it reasonably forms the opinion that the entry has been entered using false information or via automated entry means or by use of a competition entry service.

4. Prize

1. Prizes on offer are valued at $330 and include:
   a) $100 voucher to redeem with EGS as a contribution towards a guided fishing charter at a either Mallacoota, Bemm River or Lake Tyers;
   b) selection of soft plastic lures from Prolure Australia valued at AUD$85 RRP.
   c) Selection of hard body lures from Prolure Australia valued at AUD$145 RRP.

2. Except as otherwise indicated, all amounts stated in these conditions are stated in Australian dollars.

3. The winner must, on request by EGS, provide evidence which, to the reasonable satisfaction of EGS, demonstrate that the winner is an eligible entrant (as per clause 2-1, 2-2 and 2-3) and has complied with the Terms and Conditions.

4. The Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize as stated. If a winner is unable to satisfy the Terms and Conditions or the Prize is not utilised or able to be taken within the specified timeframe, the Prize will be forfeited by the winner and cash will not be awarded in lieu.

5. The Prize is not transferable, exchangeable or redeemable for cash. If the Prize is unavailable, EGS reserves the right to substitute the Prize or an item (or items) of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the Prize are the sole responsibility of the winner.

6. EGS does not cover any additional costs incurred by the winner including hotel room incidentals, transport, travel insurance and any other costs incurred that are not specified within the Terms and Conditions.

7. All vouchers are valid for 1 year and subject to availability in consultation with EGS. The winner is responsible for arranging dates for redemption directly with EGS.

 

 

5. How to win

1. Each eligible entry received within the Competition Period will be entered into a random draw.

2. The draw will be conducted by EGS at 9:30am AEST Monday 4th March 2024 at Aspendale, VIC 3195. The winner will be notified by email and their name will be published on Facebook/Instagram/ @egsportfish

3. EGS’s decision is final and EGS will not enter into correspondence regarding the Competition result or any other decisions EGS makes in connection with the Promotion.

4. Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit the entry (e.g. mobile phone account holder).

5. Should an entrant’s contact details change during the Competition Period, it is the entrant's responsibility to notify the Promoter.

6. If the Prize remains unclaimed after three (3) days of notification being given, EGS may withdraw the Prize and award it to an alternative entrant by conducting an unclaimed prize draw on Thursday 7th March 2024.

7. If any draw is scheduled on a public holiday, the draw will be conducted on the following business day.

6. Liability

1. EGS and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, misadventure, accident, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

2. Subject to any restrictions at law, the liability of EGS however arising is limited to the total value of the Prize.

3. EGS is not responsible for any technical error that may occur during the administration of this Competition including but not limited to any omission, interruption, deletion, defect, delay in operation or transmission, communications, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

4. If, for any reason, this Competition is not capable of being conducted as planned, including but not limited to, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of EGS, which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Competition, EGS reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition.

 

7. Privacy

EGS collects your contact details in accordance with the Privacy and Data Protection Act 2014 (Vic) (the Act) for the purposes of the Competition. As an entrant and participant, you agree to this collection and EGS acknowledges that it will not disclose such information to any third parties save where permitted by the Act. However, by entering the Competition you consent to, and acknowledge that EGS may send you further information and promotional material relating to it’s products and services.

Without limiting any other paragraph, EGS may at its discretion amend any aspect of this Competition, subject to any applicable laws.
